What is an Employment Termination Payment?
An ETP is a lump sum payment you receive when your employment ends. It can include payments for unused sick leave, payments in lieu of notice, and gratuities. Genuine redundancy payments have different tax treatment.
How much of a genuine redundancy is tax-free?
For 2026-27, the limit is $13,598 plus $6,801 for each completed year of service. Only an eligible genuine redundancy receives this treatment; eligible excess is an ETP.
How are ETPs taxed?
For 2026-27, Schedule 11 withholds 17% within the applicable cap if you are at or above preservation age on 30 June 2027, or 32% if below. The ETP cap is $270,000; the $180,000 whole-of-income cap can reduce the cap for non-excluded life-benefit ETPs. Withholding above the applicable cap is 47%.
Is a dependant death-benefit ETP entirely tax-free?
Only within the death-benefit ETP cap. The taxable component paid to a dependant is tax-free up to $270,000 in 2026-27, with 47% withheld above the cap. A non-dependant has 32% withheld within the cap and 47% above it.
